4. Products and Orders

4.1 Product Information

We make every effort to ensure that product descriptions, images, sizing guides, and pricing on our website are accurate. However, we do not warrant that all product information is error-free, complete, or current. Colours may vary slightly due to screen display differences.

4.2 Pricing

All prices on our website are displayed in British Pounds Sterling (£) unless otherwise stated and are inclusive of Value Added Tax (VAT) at the applicable UK rate. We reserve the right to change prices at any time without prior notice. The price applicable to your order is the price displayed at the time you place your order.

In the unlikely event that a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel the order and notify you of the cancellation. If payment has already been taken, a full refund will be issued.

4.3 Order Acceptance

Placing an order through our website constitutes an offer to purchase. All orders are subject to acceptance by Alyoga. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

An order is accepted and a binding contract is formed only when we send you an Order Confirmation Email. Until that point, no contract exists between you and Alyoga.

4.4 Availability

All products are subject to availability. If a product becomes unavailable after you place your order, we will notify you as soon as possible and offer either a full refund or an alternative product of equivalent value.

5. Payment

5.1 Payment Methods

We accept the following payment methods: Visa, Mastercard, American Express, PayPal, Klarna, Clearpay, and Apple Pay. All payment transactions are processed securely through our third-party payment providers.

5.2 Payment Security

We do not store your full payment card details on our servers. All payment processing is handled by PCI DSS-compliant third-party payment processors. By providing your payment information, you authorise us to charge the total order amount (including applicable shipping costs) to your selected payment method.

5.3 Klarna & Clearpay

If you choose to pay using Klarna or Clearpay, your use of those services is subject to Klarna's or Clearpay's own terms and conditions and privacy policies. Alyoga is not responsible for any fees, charges, or issues arising from the use of third-party payment services.

8. Intellectual Property

All content on the Alyoga website, including but not limited to text, graphics, logos, images, photographs, icons, audio clips, video clips, data compilations, page layouts, underlying code, and software, is the property of Alyoga or its content suppliers and is protected by United Kingdom and international copyright, trademark, and other intellectual property laws.

8.2 Trademarks

The Alyoga name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Alyoga. You may not use these marks without our prior written permission.

8.3 Limited Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use our website for personal, non-commercial purposes. This licence does not include any right to:

  • Reproduce, distribute, modify, or create derivative works of any content on our website.
  • Use any data mining, robots, or similar data-gathering or extraction tools.
  • Download (other than page caching) any portion of the website, except as expressly permitted.

Our total aggregate liability to you for any claims arising out of or relating to our Service shall not exceed the total amount paid by you to Alyoga in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms shall exclude or limit our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law, including the Consumer Rights Act 2015.

15. Force Majeure

Alyoga shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of God, pandemics, epidemics, fire, flood, war, terrorism, strikes, government actions, supply chain disruptions, or failures of telecommunications or IT infrastructure.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Refund & Return Policy, constitute the entire agreement between you and Alyoga with respect to your use of our Service and supersede all prior or contemporaneous communications, agreements, and understandings, whether written or oral.

18. Waiver

No failure or delay by Alyoga in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy. A waiver of any right or remedy on one occasion shall not be construed as a waiver of that right or remedy on any subsequent occasion.

19. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
